​What‘s the basic information You need to know?

These Terms and Conditions apply to your use of UAB Travel Union (hereinafter – TU) Card issued to You by „Decta Limited“ („Issuer“) and operated by UAB „Travel Union“ („TU/We/Us“).

It also sets out other important things that you need to know in plain language.

The Card enables You to use the balance of Your TU e-money digital wallet (“TU Account”) to purchase goods and services online or at a point of sale and withdraw cash at relevant ATMs

Please read them carefully and keep a copy for your records. You can ask us at any time for a copy of these Terms and Conditions, our current rates of Fees and the current Usage Restrictions by contacting us using one of the Contact Methods.

In the event of a conflict between these Terms and Conditions and the e-money account terms of use, to the extent of the conflict, these Terms and Conditions shall prevail.

By applying for or activating Your Card in TU Mobile App, You are agreeing to these Terms and Conditions.

Please print or save a copy of this agreement for your records. You can ask for a copy of these terms and conditions through the TU app or find it at TU website at any time.

Currently TU offers services only in the Republic of Lithuania, though the electronic money license TU holds entitles it to provide services in other EU/EEA countries

Please note that we only provide our Services for domestic and private use. You agree not to use our Mobile Application for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

You will receive your TU Card from UAB “Travel Union” UAB, an Electronic Money Institution, registered at Saulėtekio av.17, Vilnius, Lithuania, legal entity code 304715528, company is incorporated and licensed under the laws of Republic is Lithuania.

Your TU Card will be issued by Decta Limited, electronic money institution authorized and regulated by the Financial Conduct Authority as an Electronic Money Institution in the United Kingdom with registration number 900592 and a member of MasterCard International Incorporated.

You understand and confirm that by accepting these Terms and Conditions during the TU Card registration process on our App, you agree to abide by these Terms and Conditions concerning your use of the TU Card, and you also agree to our Privacy Policy and/or Children’s Privacy Policy which forms part of these Terms and Conditions.

​By Using TU Mobile App You Accept These Terms

By using TU Mobile App, you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms, you must not use our services and TU Mobile App.

We recommend that you dowloand a copy of these terms for future reference, even though you can find all relevant versions in TU Website.

Please note that we only provide our services for domestic and private use. You agree not to use TU Mobile App for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

​We May Make Changes To These Terms

We amend these terms from time to time. Every time you wish to use TU Mobile App, please check these terms to ensure you understand the terms that apply at that time.

​You Must Keep Your Details Safe

If you choose, or you are provided with, a user identification code, passwords or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us using the customer chat function on our Mobile App or TU website

​Which Country’s Laws Apply To Any Disputes?

Please note that these terms of use, their subject matter and their formation, are governed by Lithuanian law. You and we both agree that the courts of Lithuania will have exclusive jurisdiction.

All communications relating to Your Card and Account will be in English.

​Where to complain?

If you are unhappy with the service provided under these Terms andConditions please contact TU Customer Services so we can help you. If you wish to make a formal complaint, you can do so online, by phone or in writing using the TU Contact details.

If, at the end of the TU procedures, you are still unhappy, you can refer your complaint related to TU Services, you shall have the right within 1 (one) year of the day of applying to the TU, to submit a request to the out-of-court disputes settlement institution – the Bank of Lithuania (address: Žirmūnų g. 151, LT-09128 Vilnius, e-mail: pt@lb.lt, internet website: www.lb.lt).

​What fees are applicable?

All Fees and Charges relating to the Card are detailed on the fees page of the TU Website. Fees will be deducted from your TU Account balance, if any.

​When to report?

If Your physical Card is lost or stolen You must report it immediately by logging into your TU Account and using the TU Mobile App facility or by calling our 24 hours support line. We will take immediate action to protect the funds in Your TU Account and cancel Your Card.

You can temporarily block the Card at any time by logging into your TU Account via TU Mobile App and using the “block” functionality.

If there are sufficient funds in Your TU Account to cover the delivery fee (see Fees), We will issue a new Card to Your current address within seven days.

If You believe that any of the transactions on Your TU Card were unauthorised or incorrectly posted to Your TU Account, You must notify TU Customer Services as soon as You become aware but not later than 13 months of the date of the debit to Your Account. If the transaction is one where the exact amount of the transaction was unknown at the time of authorisation (e.g. car hire or a hotel reservation) and the transaction amount appears incorrect, You must notify Us within eight (8) weeks of the date of the debit to Your TU Account.

​Our Responsibility For Loss Or Damage Suffered By You

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

Different limitations and exclusions of liability will apply to liability arising as a result of the sale of electronic money and other services we provide to you, which will be set out in our Electronic Money Terms

If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.

​How we use your personal data?

TU and the Issuer are each independent data controllers of personal data provided to Us in connection with Your Card. Information on how TU use and protect your personal data is available in the TU Privacy Policy on www.travelunion.eu .

We will process and retain personal data in order to open and administer Your TU Card, to deal with any enquiries You have about it and comply with our Regulatory obligations. The types of personal data processed are likely to include, inter alia name, address, date of birth, contact details, financial information, employment details, device identifiers.

If We suspect that We have been given false or inaccurate information, We may record Our suspicion together with any other relevant information.Decisions may be made by automated means.

We and other organisations may also access and use this information to prevent fraud and money laundering. When We process Your personal data, we do so on the basis We have a legitimate interest in preventing fraud, money laundering, and to verify identity. These processes are carried out in order to protect Our business, Our customers, and to comply with regulatory requirements.

You can also obtain any details of the information We hold about You and/or details of any other person to whom We may pass Your information, by writing to Us. You have a legal right to these details and, where applicable, to object to Us processing Your personal data and/or request that Your data is corrected or erased.

​What to do if you change personal details ?

If You change name, address or contact details such as telephone numbers or an e-mail address You must notify TU within 14 days of the change.

It is also important to notify TU without delay of any changes to Your circumstances that may affect the running of Your TU Account or Your TU Card, by contacting Customer Services

​How to apply for the TU Cards?

To apply for TU Cards, you must be:

Where we are not able to verify your identity, we may ask that you provide further supporting documentation including scanned copies or photos of identification documentation (either your passport or driving license) and proof of your residential address and/or custodian documents until we are able to verify your identity successfully. If we are unable to verify your identity based on the documentation you have provided, in certain circumstances we may ask you to provide certified copies of the supporting documentation to help us verify your identity.

If you have not completed any of the steps set out above, you cannot complete the TU Account and TU Card application process.

If you already have created a TU account there is no need to repeat identity verification process unless it is required due to some reasonable measures.

The TU Card enables you to hold stored value (known as “electronic money” or “e-money”) which can be spent using your TU Card. You can use TU plastic card at any location that displays the MasterCard® acceptance mark, including shops, restaurants, online, or on the telephone. TU virtual card can be used for online transactions only. Before using the TU Card you need to make sure there are enough funds loaded on it.

Once you have received and TU Card it is already activated. You can configure activation of your TU Card on the TU App. You will not be able to use your TU Card’s Contactless payments until you have made the first POS transactions via your TU Card.

​Authorizing Transactions

You can access information on any transaction you have made by accessing your Card Account through the TU Mobile App. This will provide you with detailed information including the Fees you have paid in relation to any transaction.

For any MasterCard Transaction or ATM/bank withdrawal, we receive your transaction instruction from the Merchant or ATM/bank withdrawal service provider via the MasterCard network. For any other transactions, including a request to Redeem the funds on your Card, we receive your transaction message at the time you ask us to complete the transaction.

TU will deduct the value of your transactions from the balance on your Card and any applicable Fees at the time of the transaction. If you make a transaction, any applicable Fees will be added to the amount of the transaction so that the total sum of your transaction amount plus the applicable Fees will be deducted from your Card.

You can withdraw or revoke your authorization for a Transaction at any time until the authorization is received by us, using one of the Contact Methods. Authorization for a Transaction may not be withdrawn or revoked by you once it is received by us although in the case of a POS Transaction, the merchant may give you a refund.

You may check your balance and transaction history by logging into your Card Account on our TU Mobile App. We will update your transaction history near real-time. Your transaction history will show:

You will be able to see separate card transactions history and statements for your Card from your TU account.

We recommend you check your Card balance and transaction history regularly and inform us regarding any suspicious transactions or transaction you do not recognize or disagree with as soon as possible

​What liabilities rules You need to follow?

If something which We are not reasonably able to control, including but not limited to defects relating to the Card or Account, stops or delays Us from doing something We are supposed to do under these Terms and Conditions,We will not be responsible for any loss which You may suffer.

If You are affected by something which is Our fault or was in our reasonable control to prevent, We will only be responsible for the financial loss actually debited from your Account and not for any other loss whatsoever (for example, loss of reputation and indirect and consequential losses).

Provided You have not acted fraudulently or with gross negligence Your maximum liability for any transactions or fees incurred on Your Card if someone else uses Your Card before You report it lost or stolen will be 50.00 EUR.“Gross negligence” could include keeping Your PIN close to Your Card, so that both are easy to use by a third party.

You will be responsible for

In the event that You do not use Your Card in accordance with these Terms and Conditions or We find that You are using the Card fraudulently, We reserve the right to charge You for any reasonable costs that We incur in taking action to stop You using this Card and to recover any monies owed as a result of Your activities.

We accept no responsibility or liability for the goods or services that You purchase with Your TU Card or for any product or service discounts arising from the purchase with Your Card.

We accept no responsibility or liability for a merchant refusing to accept Your TU Card or failing to cancel an authorisation.

​How you will know about any changes to these terms and condition?

Except in exceptional circumstances, e.g. customer fraud or a security breach,We will give You 60 days’ notice of any material change to these Terms andConditions. Notice will be sent to the email address registered to Your Account.Changes will be deemed to have been accepted unless You notify Us to the contrary before the proposed date the change comes into effect. Rejection of any proposed changes will amount to termination of these Terms andConditions and the cancellation of Your TU Card.

​What will happen when your card expires?

Providing you have sufficient funds in your account to pay the delivery fee, Physical Cards may be automatically renewed unless you advise us 30 days in advance that you do not wish to receive a new Card.

Unless stated otherwise, Your new TU Card will be on the same pricing plan as the expiring Card.

We reserve the right, in our sole discretion not to issue a new Card.

​When your card is cancelled?

You have the right to withdraw from these Terms and Conditions and cancel Your TU Card:

We have the right to terminate this agreement and cancel a Card without cause by giving you 60 days written notice.

The Card will automatically be cancelled if:

We may at any time and without notice suspend, restrict, block or cancel Your TU Card, or refuse to issue or replace a Card for reasons relating to the following:

​When we can refuse to carry out transaction?

We may refuse to carry out a Transaction:

If we refuse to carry out a Transaction, unless informing you would compromise reasonable security measures or be otherwise unlawful, we will inform you at the earliest opportunity and in any event by the end of the Business Day following the day we have received the Transaction request. Normally we will inform you with an error message on the merchant’s or ATM operators’ terminal or website and if applicable, a receipt showing that the Transaction has not been successful, although in some instances we may inform you by phone or e-mail. You can contact the TU using any of the Contact Methods to ask for the reasons for refusing to carry out that Transaction and for an explanation of how you can correct any information we hold that led to our refusal to approve a Transaction.

​Keeping your card secured

We recommend that you check your Transaction history through the TU App on a regular basis to identify any potential unauthorized use of your TU Cards and to check for Transactions which you do not recognize. We will provide you with a statement of Transactions through the TU App on a monthly basis or upon demand and you shall keep that statement for your records for at least 18 months.
